However, it is restricted (typically) to only those with diagnosed terminal illnesses. The death sentence does not have this restriction, anyone who is willing to kill is applicable. It does not matter if they're sane or insane.

This is true, however it is purely discretionary as to whether or not the to be sentenced is indeed insane. Unless the to be sentenced is diagnosed with a mental disability applicable to their case, it is up to the jury to decide and the lawyer to prove. As such, should one who is undiagnosed but indeed insane wish to be given the death penalty they simply need not lobby for such a case. Often the case is argued by the defendent in order to achieve life sentencing rather than death, the plantiff hardly has any reason to argue this as it may only hurt their case. So it really is up to the defendent as to which of the two evils they consider to be lesser.


That is true. Back to your original argument, though, if you have a gun, why are you going to kill someone else instead of yourself? If there are the means then why use it on someone else?
